Welcome to RuggedRoute. RuggedRoute is a mobile application developed and operated by Addictive Media Productions LLC ("Addictive Media Productions," "we," "our," or "us"). RuggedRoute is a product name, not a separate legal entity. By creating an account or using our application, you agree to be bound by these Terms of Service ("Terms") with Addictive Media Productions LLC. Please read them carefully.

1. Acceptance of Terms

By accessing or using RuggedRoute, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the application.

2. Description of Service

RuggedRoute is an off-road community platform that provides trail mapping and recording, community features (clubs, chat, posts, events), map tools including offline maps and MVUM overlays, SOS alerting for community-based assistance, and an in-app economy for cosmetic items and achievements.

3. User Responsibilities

• You must provide accurate, current, and complete information when creating your account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old to use RuggedRoute.
• You are responsible for all activity that occurs under your account.
• You may not share, sell, or transfer your account to another person.
• You agree to use RuggedRoute only for lawful purposes and in compliance with all applicable laws.

4. Prohibited Uses

You agree not to:

• Harass, threaten, bully, or intimidate other users.
• Post content that is hateful, discriminatory, obscene, or that promotes illegal activity or violence.
• Trigger false SOS alerts or misuse emergency features.
• Spam, post repetitive content, or engage in unsolicited promotion.
• Impersonate other users, real people, or organizations.
• Share content that infringes the intellectual property rights of others.
• Attempt to exploit, hack, reverse-engineer, or disrupt the application or its infrastructure.
• Upload malware or any code designed to harm users or systems.
• Use automated scripts or bots to interact with the app without permission.

Violations may result in warnings, temporary suspension, or permanent account termination at our discretion.

5. SOS Feature — Important Disclaimer

• SOS alerts notify your designated emergency contacts and nearby community responders on a best-effort basis.
• We do not guarantee response times, responder availability, or successful alert delivery.
• Cellular and satellite connectivity may be unavailable in remote areas; alerts may not transmit.
• Always contact professional emergency services (911, search and rescue) in life-threatening situations.
• Misuse of the SOS feature (false alerts, pranks) will result in immediate and permanent account termination.

6. Trail Data Accuracy Disclaimer

Trail information, MVUM (Motor Vehicle Use Map) overlays, and route data provided in RuggedRoute are for informational purposes only and may be inaccurate or outdated.

• Trail conditions, access restrictions, and road statuses change frequently. User-generated content may not reflect current conditions.
• Always verify current conditions with local ranger districts and land management agencies before heading out.
• RuggedRoute is not responsible for inaccuracies in user-submitted or government-sourced trail data.
• You are solely responsible for ensuring you are legally permitted to access any trail or road.
• Off-road activities are inherently dangerous. You participate at your own risk.

7. Subscription Terms

• RuggedRoute Pro is available at $4.99/month or $39.99/year (approximately $3.33/month).
• New subscribers receive a 7-day free trial. You will not be charged during the trial period.
• After the trial, your subscription begins automatically unless you cancel before the trial ends.
• Subscriptions renew automatically at the end of each billing period.
• You may cancel your subscription at any time through the Google Play Store. Cancellation takes effect at the end of the current billing period; no partial refunds are issued.
• We reserve the right to change subscription pricing with reasonable advance notice to subscribers.

8. Content Ownership

• You retain ownership of all content you create and upload (trails, posts, photos, reviews).
• By posting content, you grant Addictive Media Productions LLC a non-exclusive, worldwide, royalty-free license to display, distribute, and use your content within the application for its intended purpose.
• You may delete your content at any time, which will revoke this license for that content.
• We reserve the right to remove content that violates these Terms or our community guidelines.

9. In-App Economy

RuggedRoute may offer in-app purchases for cosmetic items (Nuts & Bolts currency, vehicle skins, titles, badges). All purchases are final and non-refundable unless required by applicable law. Virtual items have no real-world monetary value and cannot be transferred, sold, or exchanged outside the app.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• RuggedRoute is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any damages arising from your use of the application, including but not limited to property damage, personal injury, data loss, or financial loss.
• We are not responsible for the actions of other users, community responders, or third parties.
• Our total liability to you for any claim arising from these Terms or your use of the app shall not exceed the amount you paid us in the 12 months prior to the event giving rise to the claim.

11. Termination

• You may delete your account at any time from the app settings or via our account deletion page.
• We may suspend or terminate your account for violations of these Terms, with or without notice.
• Upon termination, your right to use the application ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Texas.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of RuggedRoute after changes constitutes acceptance of the updated Terms. We will make reasonable efforts to notify you of material changes through the app.
